che modifica l'allegato della decisione di esecuzione (UE) 2020/1606 relativa ad alcune misure provvisorie di protezione contro l'influenza aviaria ad alta patogenicità del sottotipo H5N8 nei Paesi Bassi

LA COMMISSIONE EUROPEA,
visto il trattato sul funzionamento dell'Unione europea,
vista la direttiva 89/662/CEE del Consiglio, dell'11 dicembre 1989, relativa ai controlli veterinari applicabili negli scambi intracomunitari, nella prospettiva della realizzazione del mercato interno

vista la direttiva 90/425/CEE del Consiglio, del 26 giugno 1990, relativa ai controlli veterinari applicabili negli scambi intraunionali di taluni animali vivi e prodotti di origine animale, nella prospettiva della realizzazione del mercato interno

considerando quanto segue:

La decisione di esecuzione (UE) 2020/1606 della Commissione

è stata adottata in seguito alla comparsa di un focolaio di influenza aviaria ad alta patogenicità (HPAI) del sottotipo H5N8 in un'azienda in cui è tenuto pollame, situata nei Paesi Bassi, e all'istituzione di zone di protezione e sorveglianza da parte dell'autorità competente di detto Stato membro a norma della direttiva 2005/94/CE del Consiglio

La decisione di esecuzione (UE) 2020/1606 stabilisce che le zone di protezione e sorveglianza istituite dai Paesi Bassi a norma della direttiva 2005/94/CE devono comprendere almeno le aree elencate come zone di protezione e sorveglianza nell'allegato di tale decisione di esecuzione.

Dalla data di adozione della decisione di esecuzione (UE) 2020/1606 i Paesi Bassi hanno notificato alla Commissione la comparsa di un nuovo focolaio di HPAI del sottotipo H5N8 in un'azienda in cui è tenuto pollame, situata nella provincia della Gheldria (Gelderland), e hanno adottato le misure necessarie prescritte dalla direttiva 2005/94/CE, compresa l'istituzione di zone di protezione e sorveglianza intorno a questo nuovo focolaio.

La Commissione ha esaminato tali misure in collaborazione con i Paesi Bassi e ha potuto accertare che i limiti delle zone di protezione e sorveglianza istituite dall'autorità competente di tale Stato membro si trovano a una distanza sufficiente dalle aziende in cui sia stata confermata la comparsa di un focolaio di HPAI del sottotipo H5N8.

Al fine di prevenire inutili perturbazioni degli scambi all'interno dell'Unione e di evitare che paesi terzi impongano ostacoli ingiustificati agli scambi, è necessario definire rapidamente a livello dell'Unione, in collaborazione con i Paesi Bassi, le nuove zone di protezione e sorveglianza istituite in tale Stato membro in conformità alla direttiva 2005/94/CE. È pertanto opportuno modificare le zone di protezione e sorveglianza elencate per i Paesi Bassi nell'allegato della decisione di esecuzione (UE) 2020/1606.

Di conseguenza, in attesa della prossima riunione del comitato permanente per le piante, gli animali, gli alimenti e i mangimi, l'allegato della decisione di esecuzione (UE) 2020/1606 dovrebbe essere modificato per aggiornare la regionalizzazione a livello dell'Unione al fine di modificare le zone di protezione e sorveglianza istituite dai Paesi Bassi in conformità alla direttiva 2005/94/CE e la durata delle restrizioni in esse applicabili.

È pertanto opportuno modificare di conseguenza la decisione di esecuzione (UE) 2020/1606.

Data l'urgenza della situazione epidemiologica nell'Unione per quanto riguarda la diffusione dell'influenza aviaria ad alta patogenicità del sottotipo H5N8, è importante che le modifiche apportate mediante la presente decisione all'allegato della decisione di esecuzione (UE) 2020/1606 prendano effetto il prima possibile.

La presente decisione sarà riesaminata nella prossima riunione del comitato permanente per le piante, gli animali, gli alimenti e i mangimi,
HA ADOTTATO LA PRESENTE DECISIONE:

L'allegato della decisione di esecuzione (UE) 2020/1606 è sostituito dal testo che figura nell'allegato della presente decisione.
Articolo 2
Il Regno dei Paesi Bassi è destinatario della presente decisione.
