Gazzetta ufficiale dell'Unione europea IT Serie L 2026/1038 7.5.2026 DECISIONE DI ESECUZIONE (UE) 2026/1038 DELLA COMMISSIONE del 5 maggio 2026 che modifica la decisione di esecuzione (UE) 2026/820 relativa ad alcune misure di emergenza contro l’afta epizootica in Grecia [notificata con il numero C(2026) 3046] (Il testo in lingua greca è il solo facente fede) (Testo rilevante ai fini del SEE) LA COMMISSIONE EUROPEA, visto il trattato sul funzionamento dell’Unione europea, visto il regolamento (UE) 2016/429 del Parlamento europeo e del Consiglio, del 9 marzo 2016, relativo alle malattie animali trasmissibili e che modifica e abroga taluni atti in materia di sanità animale («normativa in materia di sanità animale») ( 1 ) , in particolare l’articolo 259, paragrafo 1, considerando quanto segue: (1) L’afta epizootica è una malattia virale infettiva che colpisce i mammiferi appartenenti agli ordini Artiodactyla e Proboscidea e può avere conseguenze gravi sulla popolazione animale interessata e sulla redditività dell’allevamento, perturbando i movimenti delle partite di tali animali e dei relativi prodotti all’interno dell’Unione e le esportazioni verso paesi terzi. In caso di focolaio di afta epizootica in animali vi è un grave rischio di diffusione di tale malattia ad altri stabilimenti che detengono animali delle specie elencate, quali indicate nell’allegato del regolamento di esecuzione (UE) 2018/1882 della Commissione ( 2 ) (specie elencate). (2) Il regolamento delegato (UE) 2020/687 della Commissione ( 3 ) integra le norme relative al controllo delle malattie elencate di cui all’articolo 9, paragrafo 1, lettere a), b) e c), del regolamento (UE) 2016/429 e definite come malattie di categoria A, B e C dal regolamento di esecuzione (UE) 2018/1882. In particolare, gli articoli 21 e 22 del regolamento delegato (UE) 2020/687 prevedono, in caso di presenza di un focolaio di una malattia di categoria A, compresa l’afta epizootica, l’istituzione di una zona soggetta a restrizioni e l’applicazione di determinate misure nella zona interessata. L’articolo 21, paragrafo 1, del medesimo regolamento delegato stabilisce inoltre che la zona soggetta a restrizioni comprenda una zona di protezione e una zona di sorveglianza e, se necessario, ulteriori zone soggette a restrizioni attorno o adiacenti alle zone di protezione e di sorveglianza. (3) La decisione di esecuzione (UE) 2026/820 della Commissione ( 4 ) , adottata sulla base del regolamento (UE) 2016/429, stabilisce alcune misure di emergenza relative ai focolai di afta epizootica in stabilimenti che detengono animali delle specie elencate nell’unità regionale di Lesbo in Grecia. In particolare, la decisione di esecuzione (UE) 2026/820 stabilisce che la Grecia deve istituire zone soggette a restrizioni, comprendenti zone di protezione e di sorveglianza, e un’ulteriore zona soggetta a restrizioni, conformemente all’articolo 21 del regolamento delegato (UE) 2020/687, nelle quali si applicano, almeno fino ai termini elencati nell’allegato di tale decisione di esecuzione, le misure prescritte nelle zone di protezione e di sorveglianza, e nell’ulteriore zona soggetta a restrizioni, e che le zone di protezione e di sorveglianza, e l’ulteriore zona soggetta a restrizioni, devono comprendere almeno le aree elencate in detto allegato. (4) Dall’adozione della decisione di esecuzione (UE) 2026/820 sono comparsi ulteriori focolai di afta epizootica in stabilimenti nell’unità regionale di Lesbo in Grecia, anche al di fuori delle aree attualmente elencate come zone di protezione e di sorveglianza nell’allegato della decisione di esecuzione (UE) 2026/820. (5) Di conseguenza, data l’attuale situazione epidemiologica relativa all’afta epizootica in Grecia e al fine di prevenire l’ulteriore diffusione della malattia in tale Stato membro, in altri Stati membri o in paesi terzi, è necessario riesaminare con urgenza le attuali aree elencate come zone di protezione, di sorveglianza o ulteriore zona soggetta a restrizioni nell’allegato della decisione di esecuzione (UE) 2026/820, adeguarle in termini spaziali e temporali, ove necessario, e anche istituire nuove zone di protezione e di sorveglianza tenendo conto dei focolai più recenti in Grecia. Ciò è necessario anche per prevenire inutili perturbazioni degli scambi all’interno dell’Unione ed evitare che paesi terzi impongano ostacoli ingiustificati agli scambi. (6) È pertanto opportuno modificare di conseguenza l’allegato della decisione di esecuzione (UE) 2026/820. (7) Le misure di cui alla presente decisione sono conformi al parere del comitato permanente per le piante, gli animali, gli alimenti e i mangimi, HA ADOTTATO LA PRESENTE DECISIONE: Articolo 1 L’allegato della decisione di esecuzione (UE) 2026/820 è sostituito dal testo che figura nell’allegato della presente decisione.
